TNTET  :MHC upholds govt order on TET with regard to weightage marks



The Madras High Court brought to an end a raging debate over government norms for selection of school teachers by upholding the policy giving 60 per cent weightage for Teacher Eligibility Test marks and 40 per cent weightage for marks obtained in Plus Two, degree and B.Ed courses.

A division bench, comprising Justices Satish K Agnihotri and M M Sundresh, concurred with submissions of Tamil Nadu Advocate General A L Somayaji and dismissed a batch of petitions and appeals in this regard.

"The 40 per cent of marks has been divided between the marks obtained in Plus 2 examination, degree and B.Ed examination. Therefore, the authorities have taken into consideration three different examinations. Such a yardstick adopted can only be fair and equitable," the bench said.

Two changes made after teacher selection tests were completed led to the ongoing agitations by candidates who had cleared TET or enjoy seniority in employment exchanges.

First, government said TET scores alone would not suffice for teacher posts and later it granted five-mark relaxation for reserved communities. As a result, 60 per cent of TET marks and 40 per cent of qualification exam marks were taken into account.

While 60 marks was cut off for other communities, the minimum mark was brought down to 55 for reserved communities.

Assailing the changes, the petitioners and appellants submitted that the state government did not have the power or authority to reduce the qualifying pass mark and said rights accrued to them could not be taken away by a subsequent action of the government.

The AG, however, argued that the government had statutory backing to modify the selection procedure, including fixing of qualification and marks.

Noting that the new policy would give more candidates an opportunity to participate, he said its rational yardstick could not be questioned by candidates.

The judges agreed with him and said the relaxation in the qualifying marks did not take away the rights of petitioner candidates from being considered on merit. It did not dilute, vary or modify the status of petitioner-candidates, they said.

"We also find that the methodology adopted by the authorities is more rational compared to those adopted in some other states such as Andhra Pradesh and West Bengal where less percentage of marks had been given to the marks obtained in the Teacher Eligibility Test," the bench said.

The teacher aspirants have been protesting against the weightage system introduced by the TN Teachers Recruitment Board. Apart from Teachers’ Eligibility Test (TET) scores, the evaluation method was changed to award 40 per cent weightage to plus-2, graduation and B.Ed marks. According to the protesters, the new system would give young applicants, who have not scored high marks in the TET, an edge over their older counterparts with higher TET marks.

Mr Vijayakanth urged the government to hold talks with protesting teachers to resolve the issue amicably. “The government must appoint teachers based on the marks scored in TET alone. The wieghtage system should be scrapped,” he said, demanding the state government to withhold TET exam until all graduate teachers were given appointments.

Dr S. Ramadoss noted that weightage system was not followed for recruitment of PG teachers and hence, it was unnecessary to follow this in the appointment of graduate teachers alone.

The Madras High Court bench here today stayed the appointment of Graduate Assistant Teachers and Secondary Grade Teachers, but said "counselling for the 2013-14 can be held.

Admitting a batch of petitions seeking to quash a Government Order of May 30 this eyar giving weightage of marks taking into account marks obtained by the candidates in the higher secondary course, degree course, B.Ed and Teacher Eligibility Test, Justice K K Sasidharan stayed the appointment and sought the reply of the officials including the Chairman of Teachers Recruitment Board within three weeks.

One of the 18 petitioners V Tamilarasan, submitted that though he secured as high as 92 marks out 150 in the TET, he could not get a posting because the G.O. Prescribed weightage of marks taking into account marks obtained in plus two, degree, BEd and TET, DTeD and D.E.Ed.

The TRB couldnot treat the candidates who passed the examination now on par with those who completed examination five or ten years ago. The Government order did not give any weightage for seniority, experience.

CHENNAI: Protesting the weightage system for evaluation put in place by the Tamil Nadu Teachers Recruitment Board, nearly 1,000 aspirants staged a protest in the city on Monday, which witnessed dramatic scenes when four of them consumed pesticides in an attempt to commit suicide.

The four, Chelladurai R from Salem, Kabilan C from Chennai, Karthik from Thanjavur and Santhosh Kumar from Seerkazhi, were rushed to the Rajiv Gandhi Government General Hospital (RGGGH), where they were subsequently declared stable and out of danger, according to an hospital official.

As per a government order (GO 71) issued in June 2013, the evaluation method was changed to award 40 per cent weightage to Plus Two, graduation and B.Ed marks, apart from Teachers’ Eligibility Test (TET) scores.

The TET cut-off mark was also brought down from 90 to 82.

According to the protesters, the new system would give young applicants, who have not scored high marks in the TET, an edge over their older counterparts with higher TET marks. With the online counselling to begin on September 3, they were worried that there is not much time left to address their concern.

“I am 41 years old. I completed my plus two, graduation and B.Ed long back when the evaluation was a lot less liberal. I have not been selected even with a score 95 in my TET, which is well above the announced cut-off whereas youngsters who got just 82 have got a call for recruitment just because of their marks in Plus Two or graduation. This non-uniform system of evaluation is unfair,” said Mahalakshmi B, a teacher from Thanjavur.

The protesters first took out a procession from Rajaratnam Stadium to Langs Garden Road, to put forth their demands to the Chief Minister J Jayalalithaa.

They alleged that the School Education Department secretary D Sabitha was indifferent to their concerns, which forced them to consume the poison to highlight the demand.

Reacting to this, Sabitha denied that any of the representatives of the protesters had met her in this connection.

Over 600,000 primary teachers' posts lying vacant

Over 600,000 posts of teachers at primary level are lying vacant under the state sector and the national literacy mission, parliament was informed on Monday.

"The total teachers post lying vacant at the primary level both under the state sector and the Sarva Shiksha Abhiyan are 6, 06, 191," human resource development Minister Smriti Irani told the Rajya Sabha in a written reply.

"The states recruits teachers based on their recruitment rules. However, teachers who are appointed have to possess requisite qualification prescribed by the National Council for Teacher Education (NCTE) and pass the Teacher Eligibility Test (TET)," she added.
Irani said that the recruitment of teachers on contract basis therefore does not affect the quality of teaching adversely as all teachers recruited have to meet the educational qualification as well as professional qualifications.

"However, professional qualifications are sometimes relaxed under section 23 of the right of children to free and compulsory education (RTE) Act, 2009 for states where there is a shortage of professionally qualified teachers, with the provision that they acquire the same through a two year training programme in distance mode," she said.

Irani also informed that the pupil teacher ratio (PTR) has improved nationally to 1:25 and most states barring Bihar, Jharkhand and Uttar Pradesh have normative PTRs.
